By accessing or using the DevWorks Studio website, services, or platform (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

We reserve the right to update or modify these Terms at any time. Continued use of our Services after any changes constitutes acceptance of the revised Terms.

DevWorks Studio provides custom software development, mobile application development, AI and NLP solutions, e-commerce platforms, DevOps and cloud infrastructure, performance optimization, and related technology consulting services.

Our platform allows users to create accounts, submit project requests, upload documents, communicate with our team, and manage service engagements through a client dashboard.

To access certain features of our Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information.

You must be at least 18 years of age to create an account and use our Services.

You agree not to use our Services to: upload or transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable; impersonate any person or entity; interfere with or disrupt the Services or servers; attempt to gain unauthorized access to any part of the Services; or use the Services for any purpose that violates applicable laws or regulations.

We reserve the right to remove any content or suspend any account that violates these Terms.

All content, features, and functionality of the DevWorks Studio website and platform, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of DevWorks Studio and are protected by copyright, trademark, and other intellectual property laws.

For custom software developed for clients: upon full payment, clients receive ownership of the custom code developed specifically for their project, unless otherwise specified in a separate project agreement. DevWorks Studio retains ownership of proprietary tools, frameworks, and reusable components used in development.

Project scope, timelines, deliverables, and pricing are defined in individual project agreements or proposals. These Terms apply in addition to any project-specific agreements.

DevWorks Studio commits to delivering projects as described in the agreed scope. Changes to project scope may require additional time and cost, which will be communicated and agreed upon before implementation.

Clients are responsible for providing timely feedback, approvals, and any required content or assets necessary for project completion.

Payment terms, including amounts, schedules, and methods, are specified in individual project agreements or service packages. All fees are non-refundable unless otherwise stated in writing.

Late payments may result in project delays or suspension of services. DevWorks Studio reserves the right to charge interest on overdue amounts at a rate of 1.5% per month or the maximum rate permitted by law, whichever is less.

To the maximum extent permitted by applicable law, DevWorks Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of our Services.

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount paid by you to DevWorks Studio in the twelve (12) months preceding the claim.

Our Services are provided "as is" and "as available" without any warranties of any kind, whether express or implied. DevWorks Studio disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that our Services will be uninterrupted, error-free, or completely secure.

Either party may terminate the use of Services at any time. DevWorks Studio reserves the right to suspend or terminate your access to the Services immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users or our business.

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or the appropriate courts.
